The Fire Protection Hub Terms & Conditions

These Terms apply to all services provided unless otherwise agreed in writing. If you do not agree to these Terms, you must not use our services. These terms and conditions should be read carefully and understood before engaging in business with The FPH. Contact should be made with the FPH team if any part of this document is not understood.

Definitions

“Company” refers to The Fire Protection Hub including its employees, agents, and contractors.

“Client” refers to any person, firm, company, or organisation that purchases services from the Company.

“Services” include, but are not limited to, fire risk assessments, fire door inspections, fire extinguisher maintenance, and fire safety training carried out by employees of the Company. These terms and conditions do not include work carried out by external contractors such as installation of fire protection measures; fire alarm systems, fire door installation etc. The FPH will from time to time recommend external contractors. Due diligence is carried out prior to any recommendation being made and we periodically inspect external contractors.

“Agreement” refers to these Terms and Conditions and any other documentation agreed in writing by both parties.

"We", "us", or "our" refers to the Company and “you” or "your" refers to the Client. By engaging our services, you agree to be bound by these Terms.

General Terms

These Terms, together with any written proposal, quotation, or agreement signed by the Client, constitute the entire agreement between you and us regarding the provision of services. They supersede all prior discussions, correspondence, and agreements.

A written quotation or proposal will be provided and must be accepted in writing before any work commences.

Dates and times for services will be agreed upon in advance. We will make every effort to adhere to the schedule, but cannot be held liable for delays outside our control.

Services               

The Company shall provide Services with reasonable skill, care, and diligence in accordance with industry standards 

Any dates or timeframes for service delivery are estimates and not guarantees unless otherwise agreed in writing. 

The Client shall provide safe and reasonable access to all relevant premises and facilities to enable the Company to perform its Services.

Client Responsibilities

The Client shall:

Ensure that premises are safe for the Company’s personnel;

Provide all relevant documentation and information necessary for the performance of services; site plans, all testing and maintenance information as well as a completed pre-visit questionnaire and previous FRA.

Act upon the recommendations made in reports or assessments in a timely manner. Any dates or timeframes for service delivery are estimates and not guarantees unless otherwise agreed in writing. 

The Client remains the Responsible Person for the site and MUST comply with the terms of each article of the Regulatory Reform (Fire Safety) Order 2005. Failure to do so can leave the Responsible Person liable to prosecution.

Fees And Payment

Fees for Services shall be as agreed in writing or as per the Company’s current price list. Quotes provided are not fixed price, due to the requirement for research and consultation with legislation and guidance.

All invoices are payable within 10 working days of the invoice date unless agreed otherwise in writing.

The Company reserves the right to charge interest at 8% above the Bank of England base rate on overdue invoices.

All prices quoted will be exclusive of VAT. VAT will be added to each invoice as a separate figure. VAT registration Number: 492 496 545

Cancellations and Rescheduling

If the Client cancels or reschedules a service appointment with less than 48 hours’ notice, the Company reserves the right to charge a cancellation fee of up to 50% of the site visit fee in accordance with the current price list (currently set to - £300.00 for a small sized premises, £350.00 for a medium sized premises and £575.00 for a large sized premises).

The Company reserves the right to reschedule appointments due to unforeseen circumstances or safety concerns. If required information is not provided in a timely manner, this could present a safety concern.

Limitations of Liability

The Company shall not be liable for any indirect, special, or consequential loss or damage. If an intrusive FRA is being carried out, written consent from the client will be required prior to the risk assessment being carried out. The client will subsequently take full responsibility for any damage that is caused that is necessary to ascertain evidence for the completion of the FRA.

The Company's liability for any claim arising under this Agreement shall be limited to the total amount paid by the Client for the relevant Services.

Nothing in this clause limits liability for death or personal injury caused by negligence or for fraud.

Insurance and Certification

The Company maintains public liability insurance and professional indemnity insurance appropriate for the Services provided. The Companies insurance provider may change from time to time. Documents will be supplied on request of the Client. 

All work shall be carried out in accordance with applicable UK fire safety laws, including the Regulatory Reform (Fire Safety) Order 2005.

Reports and Recommendations

Reports and assessments provided are based on conditions observed at the time of inspection. Photograph and video evidence will be provided where necessary within the FRA with sensitive information redacted to satisfy GDPR protocols.

It is the Client’s responsibility to implement any recommendations or required remedial actions identified in these reports. The FPH does not accept liability in the event of injury, loss of life or damage to property as a result of recommendations being disregarded by the responsible person.

Confidentiality

Both parties agree to keep confidential any information disclosed during the provision of Services, unless required by law or regulatory authorities.

Data Protection

The Company processes personal data in accordance with the UK GDPR and Data Protection Act 2018.

Termination

Either party may terminate any agreement with 30 days written notice.

The Company may terminate immediately for non-payment, breach of contract, or health and safety concerns.

Force Majeure

The Company shall not be liable for delay or failure to perform services due to events beyond its reasonable control, including but not limited to natural disasters, strikes, or equipment failure.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Country in which the Company is operating. Some forms of statute specifically refer to Fire Safety law in England and Wales. In some circumstances Scotland may fall under different legislation.

Any disputes shall be subject to the exclusive jurisdiction of the courts in the Country in which the Company is operating.
